PAYMENT TERMS

For Birthday Parties, a non-refundable deposit of £50.00 is due within 24hrs of signing this Agreement with the balance paid no later than 3 days before the event date. 

For Corporate Events, a non-refundable deposit of £100.00 is required to secure the booking with the balance paid no later than 7 days before the event date.

No booking shall be deemed confirmed until cleared funds have been received.

If payment is not received by the stated deadline, the Artist reserves the right to cancel the provisional booking and accept alternative work without liability.

Any additional time worked beyond the agreed duration shall be chargeable at the Artist’s standard hourly rate and payable immediately or within 7 days of invoice.

TERMS OF OPERATION

A selection of 12 designs is provided for all guests to choose from. Designs are often adjusted to the individual, colours matched to the clothing, simplified (if fidgety or young) or given extra details (depending on guest’s requests and time available). 

We ask all our clients to provide a suitable height table (4 ft minimum) and 4 chairs; 2 for us and 2 more for our clients. If not possible, please contact us before proceeding to sign the Agreement and make payment.

CANCELLATIONS & CHANGES

Requests to reschedule must be made at least 7 days prior to the event date. Rescheduling is subject to availability and not guaranteed.

Cancellations made less than 10 days prior to the event shall result in forfeiture of the entire booking fee, which the Client agrees represents a genuine pre-estimate of loss.

In the event the Artist is unable to attend due to illness, accident, or circumstances beyond reasonable control, reasonable efforts will be made to provide a suitable replacement.

Where a replacement cannot be provided, any monies paid shall be refunded in full, and this refund shall constitute the Client’s sole remedy, with no further liability.

ARRIVAL, SET-UP & PACK-DOWN

We arrive 30 minutes early to set up and activate the paints and stay 30 minutes later to clean and pack up. Before booking, please ensure that your chosen establishment (if not private) will allow this. We will not be able to operate fully, if not. 

The space provided should be in a well-lit area, not in a high traffic area (near a doorway, in narrow corridors or middle of the room) nor set up near speakers or sound systems.

For outdoor set up, suitable waterproof cover must be provided (gazebo or any other shelter that can protect paints from the sun or potential rain). Weather can be unpredictable and, in case of sudden rain without appropriate shelter, we would be forced to pack up immediately. Access to a tap or bathroom for our paint pots will be required.

WEATHER

For the comfort of your guests and our artists, the client agrees to provide an area with protection from extreme temperatures, sun, rain, snow and excessive wind. The client is responsible to provide an alternate indoor location in the event of inclement weather. The client agrees to pay the full amount contracted once the painter has arrived at the event location, even if it is raining.

EXTREME ADVERSE CONDITIONS

Artist has the right to cease painting and leave without refunding any monies if there are extreme adverse working conditions and the client fails to remedy the situation after it has been brought to the client’s attention.

Adverse conditions included but not limited to: destructive, violent, or extreme inappropriate behaviour of a child, pet or adult; illegal activities; or otherwise dangerous weather conditions such as extreme heat/cold or lightning.

HEALTH, SAFETY & ALLERGIES

Age Restrictions
Face painting services are provided for children aged three (3) years and over only. Children under the age of three have developing and sensitive skin, which may be more prone to irritation or adverse reactions. In addition, it is not permitted under the Artist’s insurance policy. No exceptions shall be made.

Contagious Illness
For hygiene and safety reasons, the Artist will not provide face painting services to any individual displaying symptoms of, or known to have, a contagious or infectious condition. This includes, but is not limited to: conjunctivitis, chicken pox, cold sores, flu, coughs, or other viral or bacterial illnesses. This policy is in place to prevent cross-contamination and protect all guests.

Skin Conditions, Cuts & Wounds
The Artist will not apply face paint to areas of broken skin, open wounds, cuts, abrasions, or active skin conditions, including but not limited to eczema. Face painting may only be applied to unaffected and healthy areas of skin, at the Artist’s sole discretion.

Allergies & Sensitivities
Individuals with known allergies or sensitivities to cosmetic products should not be painted. Where there is uncertainty, a patch test may be offered at the start of the event; however, the Artist accepts no liability for allergic reactions, and the decision to proceed remains the responsibility of the Client or parent/guardian.

Consent & Child Welfare
Face painting is intended to be a positive and enjoyable experience. The Artist will not paint any individual without their clear and willing consent. The Artist reserves the right to refuse service to any child who is distressed, crying, uncooperative, asleep, or being pressured to participate against their will.

Food & Drink Restrictions
For hygiene, safety, and efficiency reasons, no food or drink is permitted at the face painting area. Children must not eat, chew, or drink while being painted, due to the risk of spillage, contamination, and disruption to service.

Right to Refuse Service
The Artist reserves the right to refuse or discontinue service at any time where health, safety, hygiene, or welfare standards are not met, without refund or compensation.

LIMITATION OF LIABILITY

Nothing in this Agreement shall exclude or limit liability for death or personal injury caused by negligence.

The Artist’s total liability under this Agreement shall be limited to the total fees paid by the Client.

The Artist shall not be liable for indirect, consequential, or economic losses.

INSURANCE

We are proud members of BAPIA and have £10 million in Public Liability Insurance. Details are available upon request.

FORCE MAJEURE

Neither Party shall be liable for failure or delay in performing obligations due to events beyond reasonable control, including but not limited to acts of God, extreme weather, government restrictions, pandemics, or emergencies.

GOVERNING LAW

My Agreement shall be governed by and construed in accordance with the laws of England and Wales, and the Parties submit to the exclusive jurisdiction of the English courts.
